2. Project Requirements
Clients are responsible for providing accurate information, content, images, branding materials, and other resources required to complete the project.
Delays in providing required information or feedback may affect the project timeline.
3. Payment & Fees
- Payment must be made according to the agreed payment schedule.
- Work may begin after the required advance payment has been received.
- Any additional work outside the agreed project scope may incur additional charges.
- Outstanding payments may result in delays or suspension of the project.
- Final files, website access, or other deliverables may be provided after full payment has been received.
4. Revisions & Changes
The number of revisions included will depend on the agreed project scope or package.
Changes requested after approval or outside the original scope may be considered additional work and may incur additional charges.
5. Project Timeline
Estimated delivery times depend on the project’s scope, complexity, content availability, client feedback, and required revisions.
We will make reasonable efforts to complete projects within the agreed timeframe; however, delays caused by missing content, delayed feedback, third-party services, or circumstances outside our control may affect delivery.
6. Website Services
For website projects, the client is responsible for providing accurate business information and approved content unless content creation is specifically included in the project.
Website hosting, domain registration, premium plugins, themes, third-party software, licenses, and other external services may involve separate costs unless otherwise agreed.
7. E-commerce & Amazon Services
For e-commerce and Amazon services, we may assist with website design, product listings, Amazon Storefront design, product visuals, A+ Content, and advertising services.
The client is responsible for ensuring that their products, claims, pricing, business information, and submitted content comply with applicable laws and platform policies.
Amazon, Shopify, payment providers, advertising platforms, and other third-party services operate independently and may change their policies, features, fees, or requirements.
8. Advertising & Marketing
Advertising performance can vary based on factors such as advertising budget, competition, industry, audience, market conditions, platform algorithms, and website performance.
We do not guarantee specific numbers of leads, sales, conversions, revenue, or advertising results unless specifically agreed upon in writing.
9. Intellectual Property
- All designs, concepts, drafts, and deliverables remain the property of Graphic & Website by Monika until full payment has been received.
- After full payment, ownership of the agreed final deliverables will transfer to the client unless otherwise specified in writing.
- Unused concepts, rejected designs, drafts, and working files remain the property of Graphic & Website by Monika.
- Third-party assets such as fonts, stock images, plugins, software, and other licensed materials remain subject to their respective licensing terms.
10. Portfolio & Promotional Rights
Unless otherwise agreed in writing, Graphic & Website by Monika may display completed projects in our portfolio, website, social media, or other promotional materials.
If a project contains confidential information, the client may request that specific work not be publicly displayed.
11. Third-Party Services
Some projects may use third-party platforms, including hosting providers, domain registrars, Shopify, Amazon, Google, Meta, payment providers, plugins, themes, or other software.
We are not responsible for service interruptions, policy changes, pricing changes, account restrictions, technical problems, or other issues caused by third-party platforms.
12. Client Responsibilities
Clients agree to:
- Provide accurate information and materials.
- Own or have permission to use submitted content.
- Provide timely feedback and approvals.
- Make payments according to the agreed schedule.
- Use the delivered services and materials lawfully.
Graphic & Website by Monika is not responsible for copyright or intellectual-property claims resulting from materials supplied by the client.
13. Cancellation & Termination
A project or service may be cancelled or terminated according to the agreed project terms.
If a client cancels a project after work has started, payments already made may not be refundable where work has already been completed or costs have been incurred.
We reserve the right to suspend or terminate services in cases of non-payment, violation of these Terms & Conditions, unlawful activity, or abusive conduct.
14. Limitation of Liability
To the extent permitted by applicable law, Graphic & Website by Monika will not be liable for indirect, incidental, special, or consequential losses arising from the use of our services or third-party platforms.
We do not guarantee uninterrupted operation of websites, advertising platforms, hosting services, e-commerce platforms, or other third-party systems.
15. Privacy
Information collected through our website or services is handled according to our Privacy Policy.
